Kosovo Judicial Council gives green light for agreement with AKKVP, implementation guarantee requested

The agreement between the institutions provides for the exchange of data for handling property cases and ensuring the protection of personal data. During its review, it was requested that the document contain binding measures so that it does not remain merely formal.

The Kosovo Judicial Council (KJC) has authorized the signing of a cooperation agreement with the Kosovo Property Comparison and Verification Agency (AKKVP). Its purpose is to enable the circulation of information necessary for reviewing requests related to the legal recognition and formalization of property rights.

According to the Legal Office, the preparation of the draft was preceded by several meetings between the two institutions. The document defines the parties’ responsibilities for data exchange, protection of personal data, and how this process will be carried out.

The agreement is expected to be in force for an indefinite period.

During the KJC meeting, a member expressed concern about what would happen if the agreement is not implemented and remains only a document. He asked that the text include binding provisions that would oblige both parties to fulfill their responsibilities.

“If this agreement is not implemented, are there consequences? The reason for asking this question is that most agreements that are made, first of all, do not have mandatory provisions in them, and what if it is not implemented and remains only on paper,” the Judicial Council member said.

According to him, clearly defining the consequences for non-implementation would serve as a guarantee that the agreement would not remain only as a document on file.

After the discussions concluded, the authorization to sign the agreement was put to a vote. The chair of the Judicial Council, Rrustem Thaçi, said the decision was approved by anonymous vote.

“By anonymous vote, the chair of the KJC is authorized to sign a cooperation agreement between the Kosovo Judicial Council and the Kosovo Property Comparison and Verification Agency. The decision enters into force on 22 October,” Thaçi said.

During this meeting, the Judicial Council also considered and approved other items on the agenda.

One of the decisions was the appointment of Mejreme Memaj as administrator in the Special Chamber of the Supreme Court. She will have a four-year term, with the right to renewal, and her mandate begins on 22 October 2026.

The KJC also reviewed revisions to the work plans of the Basic Courts in Ferizaj, Pristina, and Gjakova. At the meeting, the announcement of a competition for the administrator of the Administrative Court and the creation of the commission responsible for that recruitment were also discussed.

Among other issues was the formation of the Commission for the Performance Evaluation of the former president of the Basic Court in Ferizaj. Also, the chair of the KJC was authorized to sign a cooperation agreement with the Fund for Humanitarian Law in Kosovo.

At this meeting, Burim Ademi, delegated by the Supreme Court, was also appointed as chair of the Parole Panel and reserve member.

Another proposal was that Judge Ujvesë Hysenaj, from the Basic Court in Pristina, be recommended to the Ministry of Justice as a member of the Evaluation Commission. This commission reviews applications of candidates for licensing as judicial experts.

Council members also reviewed the recommendations of the Assembly of Court Presidents and Supervising Judges.
